Classified Coffee ("Classified Coffee") and its affiliates, operate this website (the "Site") and the services related to or offered on the Site (hereinafter, the ("Services"). Classified Coffee's Services may include, without limitation, offering and selling products, tools, applications, email services, bulletin and message boards, chat areas, news groups, forums, communities, calendars, merchandise, products and downloadable mobile applications related to the Site or provided through the Site. Classified Coffee provides you this privacy policy (the "Policy") to help you understand the kinds of information Classified Coffee may gather about you when you visit the Site or use any of Classified Coffee’s Services, and how Classified Coffee may collect, use and disclose the information. The use of the phrase "Personal Information" in this Policy means information that identifies a specific person that may include as a person’s full name, address, e-mail address. The phrase "Anonymous Information" in this Policy means non-personal information that cannot reasonably be used to identify individual persons (e.g., interests, demographics, geographical location and anonymous usage data). Each time you visit the Site or use the Services, you agree and expressly consent to Classified Coffee’s collection, use and disclosure of the information that you provide as described in this Policy. Your Personal Information will be processed by Classified Coffee in the United States. In addition to this general Policy, each Service may have additional privacy provisions that are specific to the particular Service. These supplemental disclosures are made adjacent to the particular Service at the time Classified Coffee the information. These supplemental disclosures also govern the use of your information. In general you can use the Site and/or Service without telling Classified Coffee who you are or revealing any Personal Information about yourself. However, if you do not provide Classified Coffee with certain requested information, we may not be able to provide you with certain Services and features that may be contained on the Site and/or Service, including without limitation, selling the products on the Site to you.

1. INFORMATION GATHERED BY CLASSIFIED COFFEE

Classified Coffee collects information about you in the following ways:

A. Information you voluntarily provide  Classified Coffee.

Classified Coffee collects and maintains information that you voluntarily submit to Classified Coffee during your use of the Site and Services. For example:

• When you register for the Site, certain provided information to  Classified Coffee will be required such as your name and email address;
• As applicable, when you post comments and/or content on the Site and/or
• Service information about you that accompanies those posts or content, which may include a name, user name, likes, status, profile information and/or picture. This information is always public, which means it is available to everyone and may be displayed in search results on external search engines.
• As applicable, if you sign up to enter a contest or sweepstakes or receive a newsletter, if any, you may provide  Classified Coffee contact information (e.g., email or physical address);
• If you access or log-in to the Site and/or Services through a social media or other service or connect the Site and/or Services to a social media or other service, the information  Classified Coffee collects may also include your user ID and/or user name associated with that social media service, any information or content you have permitted the social media service to share with  Classified Coffee, such as your profile picture, email address or friends lists, and any information you have made public in connection with that social media service. When you access the Site and/or Services through social media services or when you connect the Site and/or Service to social media services, you are authorizing  Classified Coffee to collect, store, and use such information and in accordance with this Policy;
• If you purchase a product or service, you will be required to provide  Classified Coffee your credit card information and other Personal Information; and
• You may provide  Classified Coffee with Personal Information in the course of email, customer support interactions and surveys.

B. Information  Classified Coffee collects through your use of the Site.

As you use the Site and Services, certain information may also be passively collected. Through cookies, pixels and beacons for the purposes of targeted and retargeted advertising, log files and other technologies, Classified Coffee may collect information about how you use the Site and the Services. For example, Classified Coffee may determine through an IP address that a particular computer or device is located in Los Angeles and Classified Coffee may use this information to deliver advertisements promoting Los Angeles-based businesses. This information allows Classified Coffee to deliver more helpful information, programs, tools and advertisements. Classified Coffee may collect any content, record, or electronic communication of any kind, including without limitation, the following "Personal Information" (1) contact information, (2) e-mail address, (3) physical address, (4) demographic information, (5) information regarding your political views and opinions, (6) information we collect from surveys and questionnaires issued or collected by the Site, and (7) other personal information required to provide the Services and so that we may communicate with you and send you requested information subject to applicable laws and the terms of the Privacy Policy.

Classified Coffee may also combine online and/or offline information received from third parties ("Third Parties") with the information Classified Coffee has already collected from you via Classified Coffee’s Site and/or Services. The third party information is used for a variety of purposes including verifying other information about you and to enhance the content and advertising Classified Coffee provides to you. Classified Coffee and Third Parties may customize the advertisements that you see based upon: (i) the information that you provide Classified Coffee; (ii) data Classified Coffee receives from Third Parties; or (iii) your visits on the Site or use of Services and other websites or services (commonly referred to as "Behavioral Advertising"). Please see the "Cookies and Targeted Advertising" section below for more information on the use of tracking technologies and the information collected for Behavioral Advertising, and how you can delete cookies.

2. HOW  CLASSIFIED COFFEE USES YOUR INFORMATION

Classified Coffee may use the foregoing information gathered in the ways described below or described at the time that the information is collected.

In general, Classified Coffee and Third Parties use the foregoing information gathered as necessary or appropriate for purposes including, but not limited, to:

• administer your account;
• register you and provide you access to the Site and/or Services;
• respond to inquiries or requests in connection with the Site;
• fulfill your requests and/or orders for products or services;
• send communications and administrative emails about the Site and/or Services;
• personalize and better tailor the features, performance and support of the Site and Services for your use;
• send you Site and/or Service-related communications, including any notices
• required by law, in lieu of communication by postal mail. You may not opt out of Service-related e-mails.
• send you newsletters and other messages, including changes to features of the Site and/or Service and special offers that you may opt out of by clicking "unsubscribe" in the email. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.
• send you promotional/marketing information, offers or other information regarding opportunities and functionality that  Classified Coffee thinks would be of particular interest to you;
• improve the quality of the Site and the Services; analyze, benchmark and conduct research on user data and user interactions with the Site and Services.
• We may use and share information with those persons and third-party entities specifically involved in providing you with services from  Classified Coffee and/or services related to  Classified Coffee. In addition, we may use and share aggregated information that does not uniquely identify you when it enables us to improve and enrich our services and Site content.  Classified Coffee reserves the right to use and share your information in the event  Classified Coffee believes doing so is necessary to operate the Site or where such disclosure may be required by law, or to protect  Classified Coffee's right or the rights of others.
• Classified Coffee maintains full rights to any information collected on the Site, and may freely collect, use and disclose such information unless prohibited by this Privacy Policy or applicable law. In the event of a change in control of  Classified Coffee or sale by  Classified Coffee of substantially all of its assets, any information owned by or in the control of  Classified Coffee may be transferred to the  Classified Coffee successor, who will comply with the terms of this Privacy Policy, as it may be amended from time to time.

3. COOKIES AND TARGETED ADVERTISING

A. Tracking Technologies (e.g., Cookies)

Classified Coffee and/or Third Parties may use tacking technologies to provide you with a more personal and interactive experience with the Site and Services. These technologies may also be used to collect and store information about your usage of the Services, such as pages you have visited, the video and other content you have viewed, search queries you have run and advertisements you have seen. For contests or sweepstakes, if any, Classified Coffee may also use cookies in order to track your progress and the number of entries in some promotions. For polls, Classified Coffee may use cookies to help ensure that an individual can't vote more than once on a particular question or issue. Classified Coffee does not store Personal Information in any cookies on your computer. Cookies can be removed by following your Internet browser's directions within the help tab. In order to use certain Services offered through the Site, your web browser must accept cookies. If you choose to disable cookies, some aspects of the Site or Service may not work properly, and you may not be able to access the Site and/or Services. Classified Coffee may also use cookies, pixels, web beacons (which are usually small, transparent graphic images), operating system and device information and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit, the features and information for which you searched and viewed, the email you opened, or on which advertisements you clicked. An "Internet protocol address" or "IP Address" is a number that is automatically assigned to your computer when you use the Internet. Classified Coffee, its partners or their respective service providers, may use your IP Address when you access the Site or Services or use other means to assist with delivering geographically targeted advertisements.

We leverage various tools and services to improve your shopping experience. When you visit our site, we may send one or more cookies, i.e., a small text file containing a string of alphanumeric characters, to your computer that uniquely identifies your browser and enables sending you communications when you visit or leave our site.

Note that you can always set your browser to reject cookies or you can manually delete individual or all of the cookies on your computer by following your browser’s help file directions. Note that turning off cookies may also disable functions of many websites you visit. For example, one service we leverage is Gobot to send you messages regarding abandoned carts, shopping sessions and marketing. To enable this service, Gobot may automatically collect device type, operating system, geographic location, browser type, Internet Service Provider, and various data related to usage of our website including pages visited, links clicked, non-sensitive text entered, mouse movements, referring URL, and cookie information as detailed herein. B. Targeted Advertising

Classified Coffee works with third party companies (e.g., ad networks) that may use cookies for purposes including, without limitation, understanding Web usage patterns of users who see advertisements on the Site, controlling the sequence of advertisements you see, making sure you don't see the same advertisement too many times, determining your interests and tailoring advertisements and promotions based on those interests. The advertisement may appear when you are visiting a different section of this Site, another Site or any other website on the Internet if the website also has a relationship with Classified Coffee’s vendor. You can choose to limit Behavioral Advertising on the Site by clicking http://www.aboutads.info/choices/ and opting-out of cookies placed by those vendors listed. After you opt-out, you will still see advertisements but the advertising may not be as relevant to your interests. If you change your computer, change your browser, or delete your cookies, you will need to renew your opt-out.

Classified Coffee adheres to the Self-Regulatory Principles for Online Behavioral Advertising of the Digital Advertising Alliance (for more information click here at http://www.aboutads.info/consumers).

Advertisers or other Third Parties on the Site may also engage in Behavioral Advertising and use cookies and web beacons in the manner described above. Classified Coffee does not control these advertisers or other parties' use of cookies or web beacons or what they do with the information they collect. Many third party vendors that engage in Behavioral Advertising participate in the Network Advertising Initiative (NAI) and/or the Digital Advertising Alliance (DAA) and abide by NAI and/or DAA principles. If you wish to opt out of participating in advertising programs conducted by NAI and DAA members or learn more about the NAI and DAA, please go to the NAI OPT-OUT website (http://www.networkadvertising.org/choices/) and DAA CHOICE PAGE (http://www.aboutads.info/choices/) and follow the instructions. After you opt-out, you will still see advertisements, but the advertising may not be as relevant to your interests. 4. HOW  CLASSIFIED COFFEE DISCLOSES INFORMATION TO THIRD PARTIES

Classified Coffee may share your information with its parent companies, affiliates, and/or subsidiaries and with Third Parties under the circumstances described below. If you do not want Classified Coffee to use or disclose information collected about you in the ways identified in this Policy, you should not use the Site or Services.

We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested Third Parties to help them understand the usage patterns for certain Services.

1. Government Agencies

Classified Coffee may disclose and release your Personal Information to government representatives: (a) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (b) in special cases, such as a physical threat to you or others, a threat to homeland security, a threat to Classified Coffee’s system or network, or in any cases in which Classified Coffee believes it is reasonably necessary to investigate or prevent harm, fraud, abuse, illegal conduct or a violation or alleged violation of this Policy or other agreement Classified Coffee may have with you.

2. Service Providers

Classified Coffee may provide your Personal Information to service providers who work on its behalf or help Classified Coffee to operate Classified Coffee’s business, the Site and the Services. Examples of such service providers include vendors and suppliers that provide Classified Coffee with technology, services, and/or content for sending email, analyzing data, research, providing advertising and marketing assistance, processing payments (including credit card payments), and providing customer service. Access to your Personal Information by these service providers is limited to the information reasonably necessary to perform its limited function.

3. Third Parties

Classified Coffee may share aggregated Anonymous Information about you with the Third Parties. Aggregated information is your Anonymous Information that is combined with the Anonymous Information of other users.

Classified Coffee may also share your Personal Information with Third Parties for the purpose of providing the Services to you. If we do this, such Third Parties ' use of your information will be bound by this Privacy Policy. Please note, if you link to third party websites, please be sure to read the privacy policies of such websites and/or platforms. Classified Coffee is not responsible for information you share to Third Parties on third party websites and/or platforms.

We may store personal information in locations outside the direct control of Classified Coffee(for instance, on servers or databases co-located with hosting providers). As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

Any Personal Information or other content that you voluntarily disclose becomes available to the public, as controlled by any applicable privacy or website customization settings. To change your privacy settings on the Site, you may visit your online account with Classified Coffee. If you remove information that you posted to the Site, copies may remain viewable in cached and archived pages of the Site, or if other users have copied or saved that information.

Except as otherwise described in this Privacy Policy, Classified Coffee will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Classified Coffee, our users or others.

4. Promotional Partners

Some or all of the information collected during promotions, contest, polls, or sweepstakes (collectively, "Promotions") may be disclosed publicly. It may also be shared with other Third Parties as disclosed at the time of collection or in the Promotion rules. These Third Parties may include providers of prizes in order to update you of your status of your prize if any, or other fulfillment needs or a co-sponsor who may use your Personal Information to administer the Promotion or for their marketing purposes, but only in conformance with their privacy policy as made available to you at the time of collection. Classified Coffee is not responsible for their privacy policy or practices. When you participate in a Promotion, you are subject to any official rules for that Promotion, which may contain additional information about the specific privacy practices associated with the Promotion. Notwithstanding the foregoing, you acknowledge and agree that any voting in connection with the Site and/or Service by you shall not be deemed participation in and/or qualify as a Promotion under California law and/or for the purposes hereof, and Classified Coffee shall have no obligation and/or liability to you whatsoever in connection therewith, including without limitation, the obligation to award any prizes, gifts, and/or the assurance of any specific outcome or result.

5. Affiliated Companies

Classified Coffee may share your Personal Information and/or any other information collected hereunder with its subsidiaries and affiliated companies. Additionally, in the event Classified Coffee goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Policy.

5. Public

Classified Coffee may make message boards, chat rooms, blogs, product review forums and other interactive forums available as part of the Services. You should be aware that any information which you post to these interactive forums or otherwise choose to make publicly available, including your Personal Information, may be disclosed and available to all users who have access to that portion of the Site or Services. By using these interactive Services, you agree that Classified Coffee is not responsible for any information that you disclose or communicate in such forums, and any disclosures you make are at your own risk.

5. ACCESS AND CONTROL

At this time Classified Coffee does not respond to browser 'Do Not Track' signals, as Classified Coffee awaits the work of interested stakeholders and others to develop standards for how such signals should be interpreted.

The Site and Services are not directed or intended for children under 13 years of age. Classified Coffee does not knowingly collect Personal Information from individuals under 13 years of age. If you are under 13 years of age, you should not register or provide Personal Information on the Site or through the Services. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to Classified Coffee, please contact Classified Coffee at info@classifiedcoffee.com so that Classified Coffee may delete and remove such child's information from Classified Coffee’s systems.

You may, of course, decline to submit Personal Information through the Site and/or Service, in which case the Site and/or Service may not be able to provide certain services to you. You may decline to share information, update or correct your account information and email preferences at any time by logging into your account, or by otherwise following the prompts on the Site.

Classified Coffee offers you choices regarding the collection, use, and sharing of your Personal Information. When you receive promotional communications from Classified Coffee, you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the promotional e-mail you receive.

Keep in mind, however, that even if you delete information from your account and/or profile, Classified Coffee may retain your Personal Information in conformance with its data retention policy and Personal Information may remain within Classified Coffee’s databases, access logs, and other records. In addition, Classified Coffee is not responsible for updating or removing your Personal Information contained in the lists or databases of Third Parties who have been provided information as permitted by this Policy.

6. CALIFORNIA PRIVACY RIGHTS

Under California law, organizations are required to provide residents of the State of California access to a privacy policy that gives consumers a choice in the use of certain Personal Information by Third Parties for marketing purposes.

If you are a California resident, you have the right to request the following information regarding Classified Coffee’s use of your Personal Information. Classified Coffee will fulfill each of these requests to the extent required by law, within 45 days of receipt of a verifiable request:

1. The Personal Information  Classified Coffee Collects About You. You have the right to request the Personal Information  Classified Coffee collects about you. If you make this request,  Classified Coffee will provide you with the following (to the extent required by law):
   1. the categories of Personal Information  Classified Coffee collects about you;
   2. the categories of sources from which your Personal Information was collected;
   3. how your Personal Information is processed and the categories of how it was used;
   4. the categories of Third Parties with whom your Personal Information was shared;
   5. categories of Personal Information  Classified Coffee has sold to Third Parties and the categories of such Third Parties. If  Classified Coffee has not sold your Personal Information,  Classified Coffee will make that clear in its response.  Classified Coffee’s response will be limited to Personal Information collected about you within the last twelve (12) months.
2. Deletion of Your Personal Information. You have the right to request that  Classified Coffee delete Personal Information collected by  Classified Coffee. Upon receipt of such request,  Classified Coffee will delete your Personal Information collected as of the date of such request, except when necessary to:
   1. complete the transaction for which the Personal Information was provided or perform a contract with the you;
   2. detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity and prosecute those responsible;
   3. debug to identify and repair errors that impair existing intended functionality;
   4. exercise free speech (of business or another consumer) or other rights;
   5. comply with the California Electronic Communications Privacy Act;
   6. engage in public or peer reviewed research in the public interest;
   7. enable internal uses reasonably aligned with the expectations of the consumer based on their relationship with the business; and
   8. comply with a legal obligation;
   9. use your Personal Information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information. Please note that if  Classified Coffee deletes your Personal Information, you may not be able to use certain Site functions that require your Personal Information.
3. Selling Your Personal Information.  Classified Coffee does not sell your Personal Information. However, as a California resident, you have the right to opt-out of any transfer or sale of your Personal Information  Classified Coffee collects about you. If you choose to opt out, please click the “Do Not Sell My Personal Information” button located on the home page of the Site.

For all requests, please include your name, street address, city, state and zip code. We are not to be responsible for notices that are not labeled, are sent improperly or do not have complete information.

7. YOUR RIGHTS

If you are a European resident, you have the right to access personal information Classified Coffee holds about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact Classified Coffee through info@classifiedcoffee.com. Additionally, if you are a European resident Classified Coffee hereby notes that it is processing your information in order to fulfill contracts Classified Coffee might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

8. OTHER IMPORTANT INFORMATION

THIRD PARTY EMAIL AND SMS SERVICES:

We use Klayvio for email and sms services. Klayvio’s privacy policy also applies to our customers and users. Their privacy policy is below, and is hereby made a part of our privacy policy by this reference.

Klaviyo provides marketing technology services to other businesses. To take advantage of Klayvio services, our clients share with us information about their individual consumers, including contact details and shopping histories. We analyze that information and develop and send communications to the consumers only at the direction of the client who provided the information, and only on that client’s behalf. We may also collect personal data for our own business purposes in connection with our business, such as business contact details of potential customers or job applicants’ resumes. We do not collect employee or HR related data in the EU or Switzerland, or transfer such information either into or out of the EU or Switzerland.

This Privacy Notice applies to:

• The klaviyo.com website and any other websites or online services controlled by us and which display this Privacy Notice, and
• Marketing technology services that we provide to our clients.

Our website and online services are designed for businesses and are not intended for personal, family or household use. Accordingly, we treat all personal information covered by this Privacy Policy, including information about any visitors to our website, as pertaining to individuals acting as business representatives, rather than in their personal capacity.

We may collect information about individuals who interact with Klaviyo when using our website or services (such as employees of our clients), job applicants, and other individuals.

• Personal and business contact information (such as name, business name, address, telephone number, email address, and mailing address)

• We do not collect employee or HR related data in the EU or Switzerland, or transfer such information either into or out of the EU or Switzerland.

Information We Collect from or on Behalf of Our Clients

We may collect information about individual consumers from our clients or – at clients’ request– from their service providers. Our clients determine the scope of the information transferred to us, and the information we receive may vary by client. Typically, we may collect clients’ consumers’ contact details and demographic data, shopping histories, and details about consumers’ interactions with marketing communications.

COOKIES AND OTHER INFORMATION COLLECTED BY AUTOMATED MEANS

We, our service providers, and our business partners, may collect certain information about the use of our websites by automated means, such as cookies, web beacons and other technologies. Likewise, as part of our services, we may offer our clients the ability to install these types of technologies on their websites or in the emails they send to their customers; and if a client does so, we collect information on its behalf. A “cookie” is a text file that websites send to a visitor‘s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, is used to transmit information back to a web server. We and our service providers and business partners may collect information about your online activities over time and across third-party websites when you use our websites and mobile applications.

Because there is not yet a consensus on how companies should respond to web browser-based do-not-track (“DNT”) mechanisms, we do not respond to web browser-based DNT signals at this time. Please see the “Privacy Preferences, Rights and Choices” section below for information about how you may opt out of, or limit the use of, your browsing behavior for online behavioral advertising purposes.

The information we collect by automated means varies based on whether we are collecting information for our own business purposes or whether we are collecting information from or on behalf of our customers to provide our services.

Klaviyo has implemented the invisible reCAPTCHA and is subject to the Google Privacy Policy and Terms of Service.

Our Use of Personal Information for Klaviyo’s Own Business Purposes

We may use personal information to:

• Provide our services to our clients
• Communicate about the products and services we offer, and respond to requests, inquiries, comments, and suggestions

• Operate, evaluate and improve our business, our websites, and other products and services we offer (including to develop new products and services)

• Administer surveys and other market research
• Comply with legal requirements, judicial process, and our company policies (including to verify users’ identity in connection with access or correction requests)
• Protect against, identify, investigate, and respond to fraud, illegal activity (such as incidents of hacking or misuse of our websites and mobile applications), and claims and other liabilities, including by enforcing the terms and conditions that govern the services we provide
• Process employment applications
• Monitor recruiting statistics, to inform our recruitment activities

We may aggregate and/or de-identify any information that we collect, such that the information no longer identifies any specific individual. We may use, disclose and otherwise process such information for our own legitimate business purposes – including historical and statistical analysis and business planning – without restriction.

Our Use of Personal Information on Behalf of our Clients

We use personal information we collect from or on behalf of our clients to provide services to our clients at their direction. We do not use this information for Klaviyo’s own purposes. We use personal information only as directed or authorized by our client. Typically, we are directed or authorized to use personal information collected on behalf of the client to:

• Help customize marketing strategy for our clients
• Personalize marketing content for our clients’ customers
• Target customers for our clients’ marketing campaigns
• Analyze and enhance our clients’ communications and strategies (including by identifying when emails sent to you have been received and read)
• Analyze results from marketing campaigns for our clients

INFORMATION WE SHARE

We may share personal information for the purposes set out in this Privacy Notice with:

• Service providers that perform services on our behalf, such as technology providers (including providers of payment processing, technology support, web hosting, and email communications)
• Survey and market research providers
• Advertising and marketing partners
• Analytics organizations

Unless prohibited by applicable law, we reserve the right to transfer the information we maintain in the event we sell or transfer all or a portion of our business or assets. If we engage in such a sale or transfer, we will – where required by applicable law – make reasonable efforts to direct the recipient to use your personal information in a manner that is consistent with this Privacy Notice. After such a sale or transfer, you may contact the recipient with any inquiries concerning the processing of your personal information.

In addition, we may share your information to comply with legal and regulatory requirements, and protect against and prevent fraud, illegal activity (such as identifying and responding to incidents of hacking or misuse of our websites and mobile applications), and claims and other liabilities.

CAREERS

If you submit your information in connection with job opportunities at Klaviyo, we will use and disclose the information to process your application (including to contact you and/or your references and former employers if appropriate), to monitor recruitment statistics, and to comply with government reporting requirements. We also retain statistical information about applicants to help inform our recruitment activities. We will process this information based on our legitimate interest of evaluating job candidates or, when you provide us with sensitive information, based on your consent.

PRIVACY PREFERENCES, RIGHTS, AND CHOICES

Individuals have certain rights and choices regarding Klaviyo’s processing of their personal information. Please note, however, that if the exercise of these rights limits our ability to process personal information, we may be precluded from providing our products or services to individuals who exercise these rights, or from otherwise engaging with such individuals going forward.

Individuals whose personal information Klaviyo processes on behalf of a client should contact that client to exercise the rights and choices described in this section.

We reserve the right to verify the identity of the individual in connection with any requests regarding personal information to help ensure that we provide the information to individuals to whom the information pertains, and allow only those individuals or their authorized representatives to exercise rights with respect to that information.

General Objections to the Processing of Personal Information

To the extent provided by applicable law, you may withdraw any consent you previously provided to us, or object at any time on legitimate grounds, to the processing of your personal information. We will apply your preferences going forward. In some circumstances, withdrawing your consent to Klaviyo’s use or disclosure of your personal information will mean that Klaviyo will not be able to provide products or services to you or to otherwise engage with you.

Access to Personal Information

You may request access to correct, amend, or delete the personal information that we maintain about you. If we grant your request, we will provide you with a copy of the personal information we maintain about you in the ordinary course of business, in a commonly used format. You may request to correct any errors in your personal information. We may reject your request to access or correct your information, as permitted by applicable law. We will also provide an EU or Swiss individuals with opt-out or opt-in choice before we share their data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

Portability of Personal Information

You may request that we transfer your personal information to another data controller. We may reject your request, as permitted by applicable law. If we reject your request, we will notify you of the reasons for the rejection.

You may request that we delete your personal information. We may reject your request, as permitted by applicable law. If we reject your request, we will notify you of the reasons for the rejection.

Marketing Emails

You may unsubscribe from receiving marketing or other commercial emails from Klaviyo by following the instructions included in the email. However, even if you opt out of receiving such communications, we retain the right to send you non-marketing communications (such as information about changes to our website terms).

Online Behavioral Advertising

Some of the business partners that collect information about users’ activities on our websites may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior for purposes of targeted advertising. For example, users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. European users may opt out of receiving targeted advertising on websites through members of the European Interactive Digital Advertising Alliance by clicking here, selecting the user’s country, and then clicking “Choices” (or similarly-titled link). Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above.

INTERNATIONAL DATA TRANSFERS

We may transfer personal information to countries other than the country in which the data was originally collected for the purposes described in this Privacy Notice. For example, if you are located outside of the United States, we typically transfer your personal information to the United States, where Klaviyo is headquartered. The countries to which we transfer personal information may not have the same data protection laws as the country in which you initially provided the information.

EU-US PRIVACY SHIELD & SWISS-US PRIVACY SHIELD CERTIFICATIONS

Klaviyo participates in the EU-US Privacy Shield framework and Swiss-U.S. Privacy Shield framework.

Klaviyo complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and/or Switzerland to the United States. Klaviyo has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. HOW WE PROTECT INFORMATION

We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we maintain against accidental, unlawful, or unauthorized access, disclosure, alteration, use, loss, or destruction. However, we cannot guarantee that the safeguards we maintain will ensure the security of the personal information.

LINKS TO OTHER WEBSITES AND THIRD-PARTY CONTENT

We may provide links to websites and other third-party content that is not owned or operated by Klaviyo. The websites and third-party content to which we link may have separate privacy notices or policies. Klaviyo is not responsible for the privacy practices of any entity that it does not own or control.

CHANGES TO OUR PRIVACY NOTICE

Klaviyo reserves the right to change this Privacy Notice at any time. When we update this Privacy Notice, we will notify you of changes that are deemed material under applicable legal requirements by updating the date of this Privacy Notice and providing other notification as required by applicable law. We may also notify you of changes to the Privacy Notice in other ways, such as via email or other contact information you have provided.

DATA RETENTION

We will retain personal information only for as long as necessary to fulfill the purpose(s) for which the information was collected, depending on the purpose(s) for which the information was collected, the nature of the information, any contractual relationship that may govern the retention of the data, and our legal or regulatory obligations. We will then destroy the personal information or anonymize the information, in accordance with applicable law.
